As UPB is a user of the RCTS network (FCCN’s Network for Science, Technology and Society), any use of UPB’s technological infrastructures that violates the rules set out in the network’s User Charter (rules available at www.fccn.pt) is not permitted.
The use of UPB’s technological infrastructures does not permit any action that violates the rules set out in this document or the legal provisions in force, with particular emphasis on the provisions set out in the applicable legislation on cyberspace security, personal data protection and computer crime.
The use of UPB resources should be guided by responsible use, and situations that interfere or may interfere in a harmful way with other users or services, whether internal or external to UPB, are not considered responsible use:
-
- for the purpose of carrying out illegal or illegitimate activities;
-
- with the purpose of disrespecting the physical and moral integrity of members of the academic community and the general public, in acts promoting harassment, xenophobia, terrorism or defamation;
-
- for creating, transmitting or accessing content without respecting intellectual property, copyright or trademark rights;
-
- for the exercise of private activities, including cryptocurrency mining and the sale of services and products;
-
- to obtain or attempt to obtain unauthorized access or to identify vulnerabilities in systems or technological infrastructures;
-
- other situations not listed above that could interfere with the safety of the infrastructure and its responsible use.
The resources made available through UPB’s technological infrastructures may not be made available to third parties – by way of sale, rental or transfer.
In certain cases, and always subject to the prior authorization of the President of the UPB or his delegate, access may be granted to third parties, in particular institutions in the education, science, technology and culture system with which the UPB collaborates.
Any unauthorized use of the resources made available by the UPB’s technological infrastructures is considered misuse and, as such, is subject to disciplinary and criminal proceedings.
The use of UPB’s technological infrastructures must be carried out in strict accordance with the institution’s statutes, with a view to pursuing its mission, under the terms of article 2 of Law no. 62/2007, of 10 September (which approves the Legal Framework for Higher Education Institutions).
The principle of responsible use applies to all users of UPB infrastructures. UPB reserves the right to change the conditions expressed herein and apply containment measures in situations where it believes that the use of its technological resources is not in accordance with the above.
UPB’s technological infrastructures may not be used for commercial purposes or, in general, for purposes that are not compatible with UPB’s institutional purpose. The use of technological infrastructures for advertising purposes is only authorised to promote activities within the scope of the Institute’s mission.
Users are expected to conduct themselves in accordance with the applicable laws and the provisions of this policy, and ignorance of them is no justification for violating them.
Users of the UPB’s technological infrastructures are considered to be the following users with a contractual relationship, namely: teachers, researchers, non-teaching staff, grant holders and other service providers. Students, retirees and retired or emeritus professors are also considered users. It is also possible to create accounts for other elements with occasional or temporary links to the UPB, and the registration of these users requires the responsibility of a user with a contractual link and the skills to do so.
It also applies to users with no connection to the UPB who occasionally use the technological infrastructure for various purposes such as submitting applications, registering for courses or using a service provided by the UPB via electronic means.
Depending on the type and profile of user and their needs, access to technological infrastructures may be granted in different ways.
The purpose of the Policy for the Use of UPB’s Technological Infrastructures is to define the guiding principles for the correct and responsible use of technological resources, with a view to the security of the organisation, its users and the pursuit of UPB’s Mission.
Policy for the Use of Technological Infrastructures
The Bragança Polytechnic University (hereinafter referred to as UPB) recognizes the right of citizens to the protection of their personal data, ensuring that all holders of personal data who entrust the processing of such data to UPB are aware of the purpose and processing of the information provided, as well as their rights in this regard and how to exercise them, under the terms and in accordance with the provisions of Article 8 of the Charter of Fundamental Rights of the European Union (“Charter”), Article 16(1) of the Treaty on the Functioning of the European Union (TFEU) and the General Data Protection Regulation. This is in accordance with Article 8(1) of the Charter of Fundamental Rights of the European Union (“Charter”), Article 16(1) of the Treaty on the Functioning of the European Union (TFEU) and the General Data Protection Regulation (GDPR).
In this context, and bearing in mind that the pursuit of such goals depends on a solid combination of responsible users, appropriate technologies and secure processes, the UPB, under the provisions of Article 24(2) of the GDPR, and in strict compliance with the legal requirements prescribed by Articles 136(1) and 136(4) of the Code of Administrative Procedure (approved by Decree-Law 4/2015, of January 7), establishes this Policy on the Use of Technological Infrastructures, aimed at facilitating the effective implementation of the GDPR. º 4 of the Code of Administrative Procedure (approved by Decree-Law no. 4/2015, of January 7th), establishes this Policy for the Use of Technological Infrastructures, with the aim of facilitating the effective application of the GDPR within the framework of its own characteristics and specificities as a Public Higher Education Institution.

The fulfilment of certain tasks by UPB may involve the transfer of your data outside Portugal. UPB will check in advance that the country or territory to which it is transferring the data guarantees an adequate level of data protection or has been the subject of an adequacy decision by the European Union. If this is the case, UPB will strictly comply with the applicable legal provisions, as well as the relevant guidelines.
Within the scope of its duties, UPB may use third-party subcontractors to provide certain services. When data processing is carried out by a subcontractor or third party to whom data is transmitted, UPB checks that the subcontractor provides sufficient guarantees that appropriate technical and organisational measures are in place so that the processing meets the requirements of the legislation in force and ensures that the rights of the data subject are upheld.
Processing under these terms is regulated by a contract or other legal act, which binds the processor or third party to the guidelines established by UPB, as the entity responsible for processing the data, and defines the object and duration of the processing, the nature and purpose of the processing, the type of personal data and categories of data subjects, and the obligations and rights of the controller.
In particular, the contract stipulates that the subcontractor or third party:
a) It only processes personal data transmitted on documented instructions from the UPB, including with regard to data transfers to third countries or international organisations, unless it is required to do so by Union law or the law of the Member State to which it is subject, in which case it informs the controller of this legal requirement prior to processing, unless the law prohibits such information for important reasons of public interest;
b) Ensures that persons authorised to process personal data undertake a confidentiality commitment or are subject to appropriate legal confidentiality obligations;
c) Adopt the most appropriate safety measures;
d) It deletes or returns to UPB all personal data after the provision of services related to the processing has been completed, deleting existing copies, unless the retention of the data is required under Union or Member State law;
e) Provides the UPB with all the information necessary to demonstrate compliance with the obligations set out in this article and facilitates and contributes to audits, including inspections, conducted by the controller or by another auditor authorised by the controller;
f) The subcontractor may not hire another subcontractor without the UPB’s authorisation, and the request must be sent to the data controller.
In any case, UPB also remains responsible for the personal data it makes available.
